1. Use of Complimentary FedEx Shipping Labels
CTP LLC offers complimentary FedEx shipping labels to approved sellers for the purpose of sending agreed-upon items to our facility. These labels:
Are valid only for the specific transaction initiated with CTP LLC.
Must not be reused, altered, duplicated, or applied to unauthorized items.
Are void if misused, and such misuse will nullify any insurance or liability coverage.
2. Insurance Coverage for Inbound Shipments
CTP LLC insures inbound shipments under its own third-party policy. You acknowledge:
Only CTP LLC is the insured party; you, the sender, are not the policyholder.
Coverage is valid only if you use the provided FedEx label and adhere to all packaging guidelines.
If any false, incomplete, or misleading information is provided (including misrepresented value, authenticity, or condition), coverage is automatically void.
The maximum insurable value is limited to the agreed-upon valuation prior to shipment.
CTP LLC will manage all claims with the insurer. You will be notified of the resolution, but you will not participate in the claims process.
3. Required Packaging Standards
To qualify for insurance and to limit liability, you must:
Use a new, unmarked FedEx box.
Securely double-box the item, placing the watch inside a protective case within a reinforced outer box.
Use protective materials (bubble wrap, foam, etc.) to prevent internal movement.
Clearly attach the FedEx shipping label provided by CTP LLC.
Photograph or video the packaging process to document the condition and compliance.
Non-compliance voids coverage.
4. Ownership, Authority & Authenticity Declaration
By sending a watch to CTP LLC, you warrant:
You are the sole legal owner or have full legal authority to sell the item.
The item is authentic and not subject to liens or claims.
Misrepresentation or sale of counterfeit items will result in legal action, and full refund of any amounts paid to you.
5. Pricing and Offer Adjustment
Quoted prices are based on your initial submission and are subject to change upon in-person evaluation. Deductions may be applied due to:
Inaccurate descriptions
Cosmetic or mechanical damage
Missing parts or accessories
Non-authentic or aftermarket components
You will be notified before any final offer is made. No payment will be issued without your approval.
6. Tracking, Delivery & Time Limits
You are responsible for tracking the shipment until it is received by CTP LLC. Any claims related to missing or delayed packages must be submitted within 30 calendar days from the shipment date.
SECTION B: Terms for Customers Receiving Purchases from WatchGuys (Outbound Shipments)
1. Insurance Coverage & Delivery
CTP LLC insures outbound shipments via designated carriers. Insurance coverage:
Commences once the package is picked up by the carrier.
Ends upon delivery confirmation via signature or 14 days from shipment, whichever is earlier.
Applies only if the delivery requires an adult signature.
Will be voided if the recipient:
Chooses “no signature” delivery.
Provides permission to leave the package unattended.
Allows redelivery to another address not authorized by CTP LLC.
Maximum coverage is based on the actual purchase value unless otherwise stated in writing.
2. Delivery Inspection Requirement
You or your authorized recipient must inspect the shipment in the presence of the carrier. If there are signs of:
Tampering
Damage
Open or re-sealed packaging
Missing contents
You must refuse delivery and require the carrier to document the issue in writing. If you accept delivery of a compromised shipment, you waive all rights to file a claim or request reimbursement.
CTP LLC is not liable for losses related to shipments marked as delivered with a valid carrier signature.
3. Claim Reporting
Any shipment issues must be reported in writing to CTP LLC at sales@watchguys.com within:
30 days of the shipment date
45 days if the package was refused and returned
Failure to report within these timeframes bars any insurance claims or resolution eligibility.
SECTION 3: General Terms for All Shipments
1. Limitation of Liability
Unless a higher value is expressly declared and confirmed in writing by CTP LLC:
Our maximum liability is limited to $100 per shipment.
CTP LLC is not liable for indirect damages, including but not limited to loss of value, market fluctuation, inconvenience, or loss of business.
2. Time-Bar for Claims
All legal claims or demands—whether related to insurance, breach of agreement, or other issues—must be initiated in writing within one (1) year from the shipment date. After this time, all claims are irrevocably time-barred.
3. Binding Arbitration Clause
You agree that any and all disputes with CTP LLC shall be resolved exclusively through binding arbitration in Los Angeles, California, under the Commercial Rules of the American Arbitration Association.
Arbitration shall be conducted before a panel of three arbitrators, each with professional experience in transportation and insurance law.
No class actions, mass arbitration, or representative claims are permitted.
Each party shall bear its own costs, and the arbitrators’ decision shall be final and binding.
4. Excluded Risks and Non-Covered Events
The following are not covered under any circumstance:
Shipment tampering accepted without documented exception at delivery
Fraudulent redirection or release based on impersonation
Losses due to incorrect or insufficient packaging
Unauthorized shipment methods
Shipments not reported to CTP LLC on the same day as tendered to carrier
Cyber events, war, or government seizures
